T Nonimmigrant Status

VAWA Self-Petition

Despite its name, VAWA protection is available to eligible applicants of any gender. An approved self-petitioner may pursue permanent residence if otherwise eligible.

Special Immigrant Juvenile Classification

Special Immigrant Juvenile classification may protect certain unmarried children in the United States who cannot reunify with one or both parents because of abuse, abandonment, neglect, or a similar basis under state law. The process normally requires a qualifying state juvenile-court order followed by a petition to USCIS. Approval may allow the child to apply for permanent residence when a visa is available.

How Is Humanitarian Immigration Different?

Family-based immigration usually depends on a qualifying family relationship, while employment-based immigration may depend on a job offer, professional qualifications, labor certification, investment, or extraordinary ability. Humanitarian cases instead focus on protection from harm or relief from urgent circumstances. They are not automatically easier; many involve strict deadlines, sensitive facts, and detailed supporting evidence.

Possible Benefits

Depending on the category, humanitarian relief may provide:

  • temporary permission to remain in or enter the United States;

  • protection from removal in certain circumstances;

  • eligibility to request employment authorization;

  • benefits for certain qualifying family members; or

Not every pathway leads to a green card. TPS and humanitarian parole are generally temporary.
