You'll find most of these on the USCIS receipt and approval notices (Form I-797) and in the Visa Bulletin.

  1. As shown on the birth certificate or passport.

  2. The date USCIS received the petition. On an I-130 that is the priority date. On a PERM-based I-140 the two differ — use the I-140 receipt date, not the earlier PERM priority date, or the pending time comes out too long.

  3. The date on the I-797 approval notice for that petition.

  4. The first day of the month in which the priority date became current according to the Visa Bulletin.

Both adjustment of status and consular processing cases follow the Final Action Dates chart of the Visa Bulletin.

The formula

CSPA age = age when a visa became available − time the petition sat pending

Understanding CSPA

How the CSPA age works

The CSPA age is the child's age on the date a visa became available, minus the time the petition was pending. If it is under 21, the child can still immigrate as a child.

  • What CSPA protects

    • A child must be under 21 to immigrate as a child on a family or employment preference petition.
    • CSPA gives back the time the petition sat pending at USCIS, so processing delays don't cost the child their eligibility.
    • The child must be unmarried and must seek permanent residence within one year of a visa becoming available.
  • What you'll need

    • The child's date of birth.
    • The petition's receipt date and approval date, both on the Form I-797 notices.
    • The Visa Bulletin month in which the priority date became current on the Final Action Dates chart.
  • Not covered here

    • Immediate relatives of U.S. citizens, whose age is fixed on the filing date with no subtraction.
    • Diversity Visa cases, which subtract a different period.
    • Asylee and refugee derivative children.
