Legal Definition

Understanding a BIA Appeal

A BIA appeal is a formal legal process in which a respondent challenges a decision made by an Immigration Judge by requesting review from the Board of Immigration Appeals (BIA).

The appeal is based on identifying legal, procedural, or factual errors in the Immigration Judge's decision—not simply disagreement with the outcome.

The BIA does not conduct new hearings or hear new testimony in most cases. It reviews the existing record to determine whether the Immigration Judge's decision was legally correct.

If you have received a removal order or denial of relief, a BIA appeal provides an opportunity to challenge that decision through a structured appellate process.

The BIA may:

Reverse

Reverse the Immigration Judge's decision.

Remand

Remand the case for further proceedings in immigration court.

Affirm

Affirm the original decision.

Types of Cases We Handle on Appeal

We represent clients in BIA appeals involving Immigration Judge decisions such as:

Asylum denial

Withholding of removal

Protection under the Convention Against Torture (CAT)

Removal or deportation orders

Denial of cancellation of removal

Other immigration court decisions affecting lawful status or relief eligibility

When a BIA Appeal May Be Filed

A BIA appeal may be appropriate if:

Your asylum or other immigration relief has been denied by an Immigration Judge.

A removal or deportation order has been issued.

You believe the Immigration Judge made legal or procedural errors in your case.

Appeals must generally be filed within 30 days of the Immigration Judge's decision.

The Process

How the BIA Appeal Process Works

1

Review the Decision

We review the Immigration Judge's written and oral decision.
2

Identify Errors

We identify the legal and factual errors in the ruling.
3

Prepare the Appellate Brief

We prepare detailed appellate arguments and a legal brief.
4

File the Notice of Appeal

We file Form EOIR-26 (Notice of Appeal).
5

Cite Legal Authority

We cite relevant statutes, case law, and precedent decisions.
6

Explain the Errors

We explain how the Immigration Judge misapplied the law or facts, and submit supporting legal authority.
7

BIA Record Review

The BIA reviews the complete immigration court record.
8

Board Decision

The Board issues a written decision.
Important to Know

Why BIA Appeals Are Complex

BIA appeals are highly technical and require precise legal argumentation.

The Board

Does not conduct new hearings.

Does not generally accept new evidence.

Reviews only the existing immigration court record.

Success on Appeal Depends On

Clear identification of legal errors.

Strong written appellate briefing and case citation.

Proper application of immigration law and precedent decisions.

How to Choose

Legal Writing Strength

BIA appeals depend heavily on written briefs, legal reasoning, and case law analysis.

3

Case Strategy

The attorney should clearly explain appeal risks, timelines, and possible outcomes.
